I was experiencing this issue consistently using logback 1.0.0 on Windows.
My configuration was using a subdirectory to hold the historical compressed log files, and I found that if the subdirectory did not exist, then this above problem consistently happened (tmp files created instead). Once I created this subdirectory, the problem disappeared.
